These Terms of Service ("Terms") govern your access to and use of the Personal Training App ("App") provided by Zaydoo ("Company," "we," "us," or "our").
IMPORTANT NOTICE: PLEASE READ THESE TERMS CAREFULLY BEFORE USING THE APP. BY DOWNLOADING, ACCESSING, OR USING THE APP, YOU AGREE TO BE BOUND BY THESE TERMS AND OUR PRIVACY POLICY. IF YOU DO NOT AGREE TO THESE TERMS, DO NOT USE THE APP.
By accessing or using the App, you confirm that you have read, understood, and agree to be bound by these Terms and the Disclaimer and Privacy Note, which are incorporated herein by reference. These Terms apply to all visitors, users, and others who access or use the App.
The App is for general informational and educational purposes only and is not intended to provide medical advice, diagnosis, opinion, treatment, or services. The App is not a substitute for professional medical or healthcare advice. You should not use the information in the App in place of a visit, consultation, or the advice of your physician or other healthcare provider.
The App is designed for users who:
- Do not have medical conditions or physical limitations that would prevent safe exercise.
Understand and accept the risks associated with physical exercise.
You must be at least 13 years old to use the App. We do not knowingly collect personal information from children under 13. If you are between 13 and 18 years old, you must have the permission of your parent or legal guardian to use the App.
To fully utilize the App's training programs, users should have access to necessary equipment: adjustable bench, dumbbells, barbell, various weights, squat rack (or stand), food scale. You are solely responsible for ensuring all equipment is in proper working condition and used correctly. You are also solely responsible for using proper form and technique, using equipment safely, stopping exercise if you experience pain or discomfort, and understanding your personal physical limitations.
5.1 SUBSCRIPTION OPTIONS: The App offers Monthly and Annual Subscription options.
- Monthly Subscription: $9.99 USD per month
5.2 PAYMENT PROCESSING: All payments are processed through Google Play Store or Apple App Store, depending on your device.
5.3 AUTOMATIC RENEWAL: Your subscription will automatically renew unless auto-renewal is turned off at least 24 hours before the end of the current billing period.
5.4 CANCELLATION POLICY: You may cancel your subscription at any time through your Google Play Store or Apple App Store account settings. Cancellation will be effective at the end of your current billing cycle. No refunds will be provided for the unused portion of your current subscription period.
5.5 PRICE CHANGES: We reserve the right to adjust pricing for our service or any components thereof. Any price changes will take effect following notice to you.
6.1 LICENSE GRANT: Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, non-sublicensable license to download and use the App on a personal device that you own or control for your personal, non-commercial use.
6.2 RESTRICTIONS: You may not:
- Copy, modify, or create derivative works of the App.
Rent, lease, lend, sell, redistribute, or sublicense the App.
Use the App for any illegal purpose or in violation of any local, state, national, or international law.
Interfere with or disrupt the integrity or performance of the App.
Attempt to gain unauthorized access to the App or its related systems or networks.
7.1 USER CONTENT: You are solely responsible for any content you create, transmit, or display while using the App. You represent and warrant that you have all necessary rights to your User Content and that it does not infringe on the rights of any third party.
7.2 PROHIBITED CONDUCT: You agree not to use the App to:
- Harass, abuse, or harm another person.
Engage in any activity that could disable, overburden, or impair the App.
Upload, post, or transmit any content that is unlawful, harmful, threatening, abusive, defamatory, vulgar, obscene, or otherwise objectionable.
The App and its original content, features, and functionality are and will remain the exclusive property of Zaydoo and its licensors. The App is protected by copyright, trademark, and other laws of the United States, the State of California, and foreign countries. Our trademarks and trade dress may not be used in connection with any product or service without the prior written consent of Zaydoo.
By using the App, you acknowledge and assume all risks associated with physical activity and exercise, including but not limited to: injuries resulting from improper use of equipment, overexertion, muscle strains, pulls, or tears, falls or collisions, and cardiovascular complications. Physical exercise, by its very nature, carries inherent risks that cannot be eliminated.
Your use of the App is also governed by our Privacy Note, which details how we collect, use, and protect your information. All your personal data, including workout history and nutrition logs, is stored locally on your device only. We do not transmit or store this data on our servers. IMPORTANT: Since all data is stored locally on your device, deleting the App will result in the permanent loss of all your data. We strongly recommend backing up your device regularly.
We may terminate or suspend your access to the App immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach these Terms. Upon termination, your right to use the App will immediately cease.
THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, Zaydoo AND ITS AFFILIATES, OFFICERS, EMPLOYEES, AGENTS, PARTNERS, AND LICENSORS DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL Zaydoo BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM (A) YOUR ACCESS TO OR USE OF OR INABILITY TO ACCESS OR USE THE APP; (B) ANY CONDUCT OR CONTENT OF ANY THIRD PARTY ON THE APP; OR (C) UNAUTHORIZED ACCESS, USE, OR ALTERATION OF YOUR TRANSMISSIONS OR CONTENT.
You agree to defend, indemnify, and hold harmless Zaydoo and its licensee and licensors, and their employees, contractors, agents, officers, and directors, from and against any and all claims, damages, obligations, losses, liabilities, costs or debt, and expenses (including but not limited to attorney's fees), resulting from or arising out of a) your use and access of the App, by you or any person using your account and password; b) a breach of these Terms; or c) your User Content.
We reserve the right to modify these Terms at any time. We will provide notice of any material changes by posting the updated Terms on the App or by other reasonable means (e.g., through email if you have provided one). Your continued use of the App after any such changes constitutes your acceptance of the new Terms.
These Terms shall be governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law provisions. You agree to submit to the personal and exclusive jurisdiction of the courts located within San Ramon, California to resolve any dispute or claim arising from these Terms.
If any provision of these Terms is held to be invalid or unenforceable by a court, the remaining provisions of these Terms will remain in effect.
These Terms, together with the Disclaimer and Privacy Note, constitute the entire agreement between you and Zaydoo regarding your use of the App.
